CARSITE TERMS

IMPORTANT NOTES

1. Information

Carsite is dedicated to gathering all the information about this vehicle to enable you to make an informed buying decision.

2. Part Exchange

We do NOT take part exchanges, but we have an agreement with http://www.partxsolution.com/ who will give an online price for your car. This transaction is completely separate from the purchase of your car from Carsite.

3. Variations to Specification

Care has been taken to check the information and specification listed, however it is possible that there may be minor inaccuracies particularly where the data provided is drawn from manufacturers’ specifications and a particular vehicle has been altered or customised.

4. Terms and conditions

Any auction, bidding, and any subsequent sale is subject to The Seller’s Terms and Conditions as set out below.

5. The £75 Handling Fee  IMPORTANT READ CAREFULLY

An eBay auction purchase requires a £75 Handling Fee to be paid. Payment of this £75 is due within 12 hours of being the winning bidder, and ensures your vehicle is prepared for you, and not re-listed back to auction. This £75 Handling Fee is an additional payment to the winning bid amount.

A Carsite “Buy it Now” purchase requires a £75 handling fee to be paid immediately to remove the car from sale.  This £75 Handling Fee is an additional payment to the BIN price.

Carsite is not The Seller of The Vehicle and it charges this fee to enable your car to be prepared for you, including cleaning the car prior to your collection and to collate all appropriate documentation (V5's etc) and receipts for you in your Carsite Purchase Pack. What’s more, your personal Carsite assistant is assigned to help you throughout the process. Carsite will also arrange with you the handover day and time and will be there to meet you at the handover centre and ensure you have sufficient time to inspect your vehicle, and have a positive buying experience.

Should you not be satisfied that The Vehicle is as described when you inspect, you will not have to complete the purchase, and your £75 Handling Fee will be refunded in full.

6. Paying Handling Fee

Carsite will guide you through making this secure payment online or you may make this over the phone with a Customer Support representative during working hours, on the direct line number which you will be given via email.

7. Collection Times

Collection is only available from The Vehicle's location (stated at the top of each listing). Collections are only able to be arranged Monday to Friday 9.30 am to 4.00pm. Unfortunately handovers cannot be arranged at weekends. We request that handovers take place between 1-5 days following receipt of the Handling Fee.

Please note: If it is your intention to transfer the money from a bank outside the UK then please ensure that your transfer includes all the bank charges attached to the transaction both from issuing bank and UK receiving bank. If payment is short we will have to request the difference before the car can be released.

9. 100% As Described Guarantee

Carsite wants to ensure that you have a great experience buying your car the Carsite way, therefore all our vehicles hold an ‘As Described Guarantee’. So if you examine the car and decide it is not as described we will not haggle or try and push you into a purchase. If it is not as described then you just walk away with no negative feedback. Please do remember all cars are sold as-is with no warranties given or implied, other than any balance of the manufacturer’s warranty that may be available to transfer.

Cars may not be returned once purchased.

10. Viewing Car

Prior to a sale being agreed, arrangements to view may be made through either the ‘Arrange a Viewing’ tab in the right-hand menu of the listing, or through Carsite on 01234 761145. Carsite viewings are available between 9 am and 4.30 pm Monday to Friday (excluding public holidays) and are strictly by appointment.

11. Rejection

Buyers are given the opportunity to reject The Vehicle upon inspection, prior to purchase, should they find The Vehicle not to be as described.

12. Carsite's Status

Carsite is a data consolidation, listing, and handover service and is not The Seller of The Vehicle.

13. UKAutoSite

UKAutoSite is a trading name of Carsite limited and references to UKAutoSite and Carsite limited on this agreement should be interpreted as such.

TERMS AND CONDITIONS

THE TERMS AND CONDITIONS AFFECTING THIS SITE

 

1) Definitions

  1. "Transaction Confirmation" is the notification sent to The Buyer following payment of the Handling Fee.
  2. "The Seller" of The Vehicle is the company or person identified as "The Seller" in the "Transaction Confirmation".
  3. "The Buyer" of The Vehicle is the person identified as "The Buyer" in the "Transaction Confirmation".
  4. UKAutoSite is a trading name of Carsite Ltd.
  5. In the case of an auction purchase, "The Price" is the amount of the successful bid as stated in the "Transaction Confirmation", which does not include the £75 Handling Fee. In the case of a ‘Buy it now’ vehicle, "The Price" is the BIN price advertised, which does not include the £75 Handling Fee.
  6. "The Vehicle" is identified in the "Transaction Confirmation" and is the motor car or other vehicle which has been the subject of the Auction or buy it now purchase.

2) Terms

  1. This agreement is made between The Seller, The Buyer and Carsite. All parties agree to be bound by these Terms and Conditions.
  2. The Buyer agrees to pay a “Handling Fee” of £75.00 to Carsite by one of the accepted methods named on the listing within 12 hours of the Winning Bid or immediately if a BIN purchase. The “Transaction Confirmation” will be sent by email to The Buyer.
  3. The Buyer agrees to arrange an inspection appointment ("The Appointment"); The Appointment to be fixed for a time no later than 5 working days from the "Transaction Confirmation" (unless an extension of this time is specifically agreed by The Seller or Carsite upon The Seller's behalf).

Prior to or at The Appointment, The Buyer must make payment for the amount of the price. The Seller will accept payment via an electronic transfer or by a banker's draft in accordance with the instructions given by email. Carsite will receive the funds on The Seller's behalf and place them into The Seller's client account. The Seller will not accept building society, personal or company cheques. In the alternative, The Buyer may make payment of The Price direct to The Seller's nominated Escrow account prior to The Appointment and The “Seller” must be in receipt of such payment and be in cleared funds prior to The Appointment.

Please note: If it is your intention to transfer the money from a bank outside the UK then please ensure that your transfer includes all the bank charges attached to the transaction both from issuing bank and UK receiving bank. If payment is short we will have to request the difference before the car can be released.

The Purchase of The Vehicle is completed at The Appointment and in the event that The Buyer rejects The Vehicle, no contract is made and the Handling Fee and, if appropriate, any further payment made by The Buyer to Carsite or The Seller's nominated Escrow account will be returned to The Buyer by way of a Cheque or Bank Transfer within 7 days of The Buyer's request for repayment.

At The Appointment, The Seller agrees to provide good title to The Vehicle. Should any relevant documents not be available at The Appointment The Seller undertakes to forward these documents to The Buyer as soon as reasonably practical after the completion of The Sale.

6)

So far as the same is permitted by statute, no conditions and warranties whether express or implied by common law, statute, custom of trade or otherwise shall be applicable to this agreement unless expressly set out herein.

7)

Provided that the Handling Fee is paid and the inspection visit takes place within the agreed times then The Vehicle shall be available for The Buyer at The Price at the time of The Appointment however if The Buyer shall commit any breach of this Agreement, The Seller shall have the right, without committing any breach of this Agreement, to sell The Vehicle to a third party. Any sale by The Seller under this sub-clause shall be without prejudice to any right of The Seller to recover damages from The Buyer in respect of a breach by The Buyer of this Agreement.

The responsibility for any motor insurance passes from The Seller to The Buyer as soon as The Buyer, or Buyer's Agent takes possession of The Vehicle or becomes the legal owner, whichever happens earlier.

9)

Any damages which may be due to The Buyer under this contract shall be limited to the repayment of sums paid to The Seller and Carsite and a further sum of up to £250.00.

10)

Carsite has acted only to provide the listing in this matter. The information and data is given in good faith however no warranty is given as to its accuracy and general specification information may be inaccurate due to changes or illegal modifications, or customisation of The Vehicle or other factors. The Buyer agrees that having been given the opportunity to inspect The Vehicle he or she waives the right to any claim in respect of any such inaccuracies. The HPI listing and information is provided under licence from HPI Ltd and no warranty is given by The Seller or Carsite as to its accuracy or content.

11)

Sums paid to Carsite shall be held in a Trust account and released to The Seller upon completion of a successful sale of The Vehicle or released to The Buyer should no sale take place. Carsite or The Seller reserve the right to delay such payments for a reasonable time to verify details of the transaction or verify identity or bank details. In exceptional circumstances Carsite reserve the right to refer the matter to a relevant court.

This is not a distance sale.

13)

The Seller has authorised Carsite to provide the listing and to receive payments referred to in this agreement and Carsite is contractually bound to comply with the terms of this agreement so far as is relevant.

14)

Carsite place great value upon its good reputation, and that of UKAutoSite, and for this reason The Buyer specifically agrees that he or she will not leave negative feedback for UKAutoSite upon eBay without having first:

  1. Notified UKAutoSite that he or she propose to leave negative feedback and to set out the reasons for their complaint in writing (The Notification).
  2. The Notification must be submitted to UKAutoSite within 14 days of any transaction or complaint during any prospective transaction as soon as reasonably possible.
  3. If requested to do so by UKAutoSite, to submit such complaint to a reputable independent mediator or the court to determine the validity of the complaint and all parties agree to be bound by any determination or finding. Such request for mediation or Reference to the Court to be made within 10 working days of The Notification.
  4. The parties agree that negative feedback shall only be posted on eBay once this procedure has been followed and the mediator or Court has found that The Seller or UKAutoSite are at fault and the Complaint is well founded and that the leaving of negative feedback is fair and reasonable in all the circumstances.
  5. Failure to abide by this procedure will make The Buyer guilty of a Breach of Contract and liable for damages, which could be substantial.
  6. Should the Buyer fail to follow the process set out in this clause and register negative feedback prematurely the Buyer must arrange the removal of the said feedback rating within 48 hours of receiving a request to do so from Carsite and should the negative feedback rating remain posted 3 days after such request the Buyer shall pay to Carsite damages of £1,000.00 plus £50.00 for each day that the feedback remains posted thereafter. This clause shall not preclude Carsite seeking further damages or injunctive relief.

15)

Any independent professional examination of a car for a prospective Buyer must be carried out by arrangement during the auction or whilst the car is still listed as a “Buy It Now”.

Collection of Personal Information

During the course of a transaction you will be requested to give certain personal information. In addition feedback information about you may be gathered in respect of any transactions you effect.

You consent to our using this information in the manner set out in this policy.

Use of Personal Information Collected

We may disclose information to any relevant or interested third party who has a legitimate interest in progressing any transaction or proposed transaction in which you have indicated you wish to participate. These will include amongst others:

Such third parties will be obliged to keep this information confidential and will not further disclose the same without your consent.

Personal information will not be sold to third parties. Your information may be shared with other UK users as is necessary to effect your transaction.

Further we will disclose information to the police or other legal enforcement agencies pursuant to a reasonable official request or in compliance with a court order or direction or in circumstances where we have a reasonable suspicion that an offence has been committed.

Rights to Access Personal Information

We will provide details of personal information held by us concerning you upon receipt of a fee of £10 to cover administration costs and upon being satisfied as to identity.
